Contest Name: The Tally Awards (the "Contest")

Contest Date: September 15, 2008 - December 15, 2008

The Tally Awards Event Partners (hereinafter the "Committee"), will conduct the Contest substantially as described in these rules, and by participating in the Contest, each person or entity so participating (hereinafter "Participant") agrees as follows:

1. Description of Contest/Participation.

a. Dates of Contest: The Contest will be conducted between September 15, 2008 and December 15, 2008.

b. How to Enter: NO PURCHASE IS NECESSARY. PURCHASE DOES NOT INCREASE ODDS OF WINNING. Odds of winning vary greatly depending on number of entrants. Void where prohibited. Deadline for registration is when the contest ends at 11:59 p.m. EST on December 15, 2008. One entry per business per category, with a maximum of 2 regular categories per business, with the exception of specialized categories such as the best overall business and best locally owned restaurant. etc.

c. How To Play: Winner(s) will be the Participant that receives the highest number of votes by registered users for a particular category. The winner(s) will be announced at The Tally Awards Night gala on January 31, 2009.


2. Prize(s)/Trophy.

A Tally Award trophy will be awarded to each winner for each voting category. For a list of categories, please see the "Award Categories" section at www.EverythingTallahassee.com.

If a winner is disqualified, the Committee reserves the right to determine an alternate winner or not to award that winner's trophy, in its sole discretion.


3. Participant Eligibility and Limitations.

  • Participant nominees must have a business located in Tallahassee or its surrounding areas and/or a valid Tallahassee business license.
  • The Committee will not be responsible for entries, which may be damaged, lost or mislaid in the post or otherwise.
  • The final vote tally is final in terms of any award made. The Committee will not be obliged to justify their decisions or enter into any correspondence.
  • Competition is open until December 15, 2008. A company or user may request a particular person or entity be entered as a Participant at any time. Participants will be entered at the sole discretion of the Committee.
  • Participants can be nominated in no more than two regular categories, subject to eligibility criteria.
  • Participants can nominate themselves.
  • A Participant is eligible to win the same award category more than once in successive years.
  • A Participant may request removal from The Tally Awards at any point in time. The request must be mailed on company letterhead to:

4. Telephone and Delivery Disclaimer.

Participants are restricted to use of ordinary and typical computer equipment and Internet access. The Committee disclaims all liability for the inability of a participant to complete or continue an entry due to equipment malfunction, busy lines, inadvertent disconnections, acts beyond the Committee's control, or otherwise. The Committee disclaims any liability for received entries due to technical difficulties or transmission errors. The Committee disclaims all liability for any delays, misdelivery, loss, or failure in the delivery of any item sent by mail, courier, express, electronic transmission, or other delivery method. The Committee is not responsible for mechanical, technical, electronic, communications, telephone, computer, hardware or software errors, malfunctions or failures of any kind, including: failed, incomplete, garbled or delayed transmission of online entries, traffic congestion on telephone lines, the Internet or at any website or lost or unavailable network connections which may limit an online entrant's ability to participate in the Contest, and any injury or damage to entrant's or any other person's computer related to or resulting from participating in or downloading any information necessary to participate in the Contest.


5. Publicity.

By participating, where allowed by law, all Participants and winner(s) grant the Committee permission to use their names, characters, photographs, voices, and likenesses in connection with promotion of this Contest and waive any claims to royalty, right, or remuneration for such use.


6. Release.

By participating in this Contest, each Participant and winner waives any and all claims of liability against the Committee, its officers, directors, members, managers, employees and agents, the Contest's sponsors and their respective officers, directors, members, managers, employees and agents, for any and all damages, injury or loss of any kind, including without limitation, damage, injury or loss to reputation and profits as well as any consequential damages, which may arise or occur from the conduct of, or participation in, the Contest, or from the use of any trophy.


7. Conduct and Decisions.

By participating in the Contest, participants agree to be bound by the decisions of Committee personnel. Persons who violate any rule, gain unfair advantage in participating in the Contest, or obtain winner status using fraudulent means will be disqualified. Unsportsmanlike, disruptive, annoying, harassing or threatening behavior is prohibited. The Committee will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Contest and the Committee's decisions concerning such disputes shall be final. If the conduct or outcome of the Contest is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of the Committee, the Committee reserves the right to terminate this Contest, or make such other decisions regarding the outcome as the Committee deems appropriate. All decisions will be made by the Committee and are final. The Committee may waive any of these rules in its sole discretion. ANY ATTEMPT BY A CONTESTANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY CIRCUMVENT, DISRUPT OR DAMAGE ORDINARY AND NORMAL OPERATION OF THIS CONTEST, TELEPHONE SYSTEMS OR WEBSITE, OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, COMMITTEE RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT PERMITTED BY LAW.


8. Miscellaneous.

The Committee may substitute prizes, amend the rules or discontinue the Contest at any time as posted on the website. The Committee disclaims any responsibility to notify participants of any aspect related to the conduct of the Contest. For a copy of the rules, or where required by law, a list of winners, please send your request by mail with a stamped, self-addressed return envelope with contest name and addressed to:

9. Compliance with Law.

The conduct of the Contest shall be governed by the laws of the State of Florida, notwithstanding the location of any Participant's main office or headquarters.
